A prisoner's security category affects almost everything about how a sentence plays out: which prison they're held in, what work and contact they can access, and how close they are to open conditions. So when a categorisation decision doesn't reflect someone's actual circumstances, it's rarely a small issue.
How categorisation decisions are made
Category reviews are meant to weigh up risk, behaviour, and progress against the relevant Prison Service Instructions. In practice, reviews don't always fully reflect someone's current circumstances, particularly where a decision leans on older information, or where a specific requirement, like reaching a certain point in a licence or release process, gets applied incorrectly.
A real example
We've represented a prisoner who was refused a move from category C to category D because he hadn't yet reached his Release on Temporary Licence date, a requirement that had been misapplied to his case. We challenged the decision by reference to the correct PSI, and it was overturned, clearing the way for a transfer to open conditions.
What a challenge looks like
A category challenge isn't a general complaint that the decision feels unfair. It's a specific written case, setting out which policy applies, how it's been misapplied or overlooked, and what the correct outcome should be.
